Kelly Rutherford’s Custody Battle Over Son’s Safety

Kelly Rutherford and Daniel Giersch are in the midst of a custody battle over their 2 year old son, Hermes. Kelly is very concerned about the safety of Hermes when he is with Daniel.
Daniel does not cover the pool at his Los Angeles home. This is a huge concern for Kelly since Hermes can very easily fall into the pool. “Hermes is very young, very active, not water safe and in a moment’s notice, could fall into the swimming pool,” says Kelly.
This is such a huge concern for Kelly that she hired a private investigator to spend three days getting footage of Daniel and his home. The video showed that the swimming pool did remain uncovered for the entire three days. However, there were no other findings.
In Daniel’s defense he stated, “Hermes is not in any danger whatsoever with regard to my pool because I have the pool fully covered with an automatic pool cover. Hermes has no access to the pool area unless I take him to the pool myself.”
After viewing all the evidence, the court ordered that Daniel keep his pool covered all the time unless he was close by. There will be another hearing on friday that will address whether or not Hermes is ready for potty training. Considering the parent’s differences in this custody battle, this may or may not have an effect in Hermes potty training abilities. Plus he’s going to be a big brother in a few weeks. Kelly is pregnant with Daniel’s child. This will be their second child. She’s due in a few weeks and will be giving birth to a baby girl.
